Work related phone use seems to be a complicated one and it appears that the legislation bought in banning the use of a phone whilst driving seem to have been fairly ineffective even though a fine and points can be awarded if you are caught doing so.
Companies are now using tracking systems to stay in continuous contact with their drivers and by having a real time view of them 24 hours a day, 365 days a year, seems to have cut out the needs for a mobile altogether in some cases. Two way messaging has also greatly added to this.
The police have taken the stand point that mobile phone usage whilst driving distracts the driver and have seized mobile phones and checked through mobile phone history if there has been an accident where there is a fatality or serious injury and the driver is thought to have been using the phone.
With regards to work related calls, if the police can show that the driver was making or receiving work related calls then the employer could possibly be prosecuted for aiding and abetting the offence. The police will check if in the case of an accident if the company have a policy in place that governs the use of mobile phones and were they adhering to it themselves as well as monitoring usage.
Some companies are taking such a stand on this now that if there drivers answer a call whilst driving they will be dismissed from work. This is feel is the only way forward and vehicle tracking systems can help resolve communication issues without having to use a phone.
